Please read these terms carefully before using PoweredADHD.

1. Acceptance of Terms

By accessing or using PoweredADHD ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and PoweredADHD ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age to use PoweredADHD. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may not share your account credentials with others or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. User Responsibilities and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Upload or transmit viruses, malware, or other malicious code
  • Use the Service to harass, abuse, or harm others
  • Scrape, crawl, or use automated means to access the Service without permission
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to send spam or unsolicited communications
  • Impersonate any person or entity or misrepresent your affiliation
  • Attempt to circumvent any content filtering or access controls

We reserve the right to investigate violations of these Terms and may take appropriate action, including suspending or terminating your account and reporting violations to law enforcement authorities.

5. Intellectual Property Rights

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of PoweredADHD and its licensors. This includes, but is not limited to:

  • All course content, educational materials, and lesson text
  • The PoweredADHD name, logo, and branding
  • The design, layout, and look-and-feel of the Service
  • All software, code, and underlying technology
  • Tool interfaces, workflows, and functionality designs

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. You may not use our trademarks without our express written permission.

6. User-Generated Content

The Service allows you to create, store, and manage personal content including:

  • Tasks, descriptions, and notes in productivity tools
  • Energy logs and personal context notes
  • Documents uploaded or pasted for reading assistance
  • Highlights, annotations, and takeaways
  • Course exercise notes and reflections
  • Daily framework structures and routines

You retain ownership of your content. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. We do not claim ownership of your content and will not use it for any purpose other than operating the Service.

You are solely responsible for your content. You represent and warrant that you have all rights necessary to submit your content and that your content does not infringe on the rights of any third party.

7. Premium Subscription Terms

PoweredADHD offers both free and premium features. Premium access may be obtained through subscription payments or promotional trial codes.

7.1 Billing and Payments

When payment processing is enabled, subscriptions are billed on a recurring basis (monthly or annually, as selected). By subscribing, you authorize us to charge your payment method automatically for each billing period until you cancel.

7.2 Trial Codes

Promotional trial codes provide temporary premium access. Trial codes are single-use, non-transferable, and subject to expiration dates. Each account may only redeem one trial code.

7.3 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain premium access until the end of your current billing period. We do not provide prorated refunds for partial billing periods.

7.4 Data Retention After Cancellation

After your premium subscription ends, we retain your premium feature data (such as saved documents and task history) for 30 days. During this retention window, you can view but not edit premium data. If you resubscribe within 30 days, your data will be fully restored. After 30 days, premium-only data may be deleted.

8. Third-Party Services

The Service integrates with third-party services to provide certain functionality:

  • OpenAI: Powers AI features such as text transformation and task decomposition. Content you submit to AI features is processed by OpenAI according to their API terms.
  • Stripe: Handles payment processing for premium subscriptions. Payment information is processed directly by Stripe and subject to their terms.

We are not responsible for the practices or policies of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

9. Disclaimers

IMPORTANT: PoweredADHD is NOT a substitute for professional medical advice, diagnosis, or treatment.

Our courses and tools are educational resources designed to help with productivity and organization. They are not medical treatments, therapy, or professional healthcare.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of content
  • Warranties that the Service will meet your specific requirements

If you have ADHD or suspect you may have ADHD, please consult with a qualified healthcare professional. Our content is designed to complement, not replace, professional guidance and treatment.

Any information provided through the Service is for general educational purposes only and should not be relied upon as a substitute for professional advice from a qualified healthcare provider, therapist, or other specialist.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PoweredADHD and its officers, directors, employees, agents, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any damages arising from your use of or inability to use the Service
  • Any damages arising from unauthorized access to or alteration of your data
  • Any damages arising from third-party conduct or content

In no event shall our total liability to you for all claims arising from or related to the Service exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Violation of applicable laws or regulations
  • Conduct that we believe is harmful to other users or the Service
  • Extended periods of inactivity
  • Request by law enforcement or government agencies

You may terminate your account at any time by deleting your account through the Settings page. Upon account deletion, all your data will be permanently removed from our systems. This action is irreversible.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page.

For significant changes, we may provide additional notice, such as an email notification or a prominent notice within the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

If you do not agree to the modified Terms, you must stop using the Service and may delete your account.
